How easy is it to fire a Realtor?
I have a vacant house in a very small California community and I expected it to be slow selling. I’ve had the house sale on contract for 6 months but I want to try another realtor (several people have called me and said they would not work with that realtor, so call them when the contract ran out…) So expecting that the contract is almost up, I check for the dates and find that I signed a 1 year selling contract (yes, I know…I signed it…). I had assumed it was just a standard 6 month contract, and there are only exactly three realtors where this property is located. As long as I do not sell to somebody that she has showed it to, can’t I just let her go no strings attached (Or sell it and give her the commission but have her exempted from the dealings)?
Sorry, bad communication on my part – the people contacting me are potential buyers that do not want to deal with my realtor, ot the other realtors in the area.

Is she her own broker or does she work for someone else? If she has a managing broker, absolutely contact them and tell them you feel duped. If she is her own broker, contact her and tell her you feel that she wasn’t completely honest and you’d like to go another direction.
Some agents are kind enough to write in a clause that allows you to end the listing agreement with 24-48 hours notice, but I somehow doubt that happened here. Can’t hurt to look for it though.

Speak to the BROKER of the company. Put it in writing that you want out of the listing agreement and see where that gets you. They may offer a different agent but, you can just say no to that as well. The other agents were so out of line to say anything negative about some that you hired and had confidence in. I hope that their comments weren’t the only thing that motivated you to make a change!? It is against the code of ETHICS in our business to bad mouth another agent that way. So consider that point as well before you make a change. That is without knowing which agent and I’m in Texas so I don’t know any of them. It is just the way we are supposed to practice. You can’t just let her go. She gets her commission no matter how the house is sold during the contract time.
Also, you certainly need to STAY AWAY from the agents that called you like that! They just proved that they have no ethics at all and are bottom feeders. I am really surprised that more then one did this, as they just risked their license in CA.
Personally I would call the DRE and complain against the scum bags that are harassing you, they are the low life’s in this little story.
Since things have changed in 6 months you should have your Realtor run you new comps. Your house may be over priced and that is the problem, not the Realtor herself. If those other 3 Realtors were so hot they would have brought you a buyer themselves by now.

You can break the contract, but you’ll still be required by law to pay her the commission agreed to in the contract. This may not be that bad if you do sell it to an individual buyer, but if you go through another realtor, you’ll have to pay double the commission for the seller’s agent.

those realtors contacting you saying that they wouldn’t work with that other realtor and to call them when the contract is up are just trying to get your listing.
