UK How much incapacity/housing benefit am I entitled to if I marry?

housing benefit
I’m on £102 p/w incapacity benefit, £1.50 income support and I get £200 p/m mortgage interest support. If I marry my partner (we dont live together at the moment but we will when we marry) who earns £23.000 p/a how much benefit will I be entitled to?
I’m British but I’m not white, and I can’t get a job because I’m disabled.

If you are british and white probably none

I think your incapacity benefit should stay the same.
but income support and housing benefit are means tested and when you are married/living together your partner’s income will be counted, so those would probably be stopped

90% of disabled people can work !

your income support will stop and so will the mortgage support because 23,000 is a sufficient wage to live on and your partner will be expected to keep you.

all you will get is your incapacity benefit but this may also be reduced.

They may change your ICB to the new ESA which will mean you have to look for a job unless your doctor and an independant doctor can prove your not fit for work, let me guess… bad back is it ?? the only thing they cannot prove

The example you give is not complete as one would need to know whether the incapacity benefit was based on previously paid NI contributions, if not the Incapacity benefit would be paid out as income support.

As you are stating that you receive mortgage interest, this implies that you have had your claim some considerable time, therefore I will assume that all benefit is coming from the taxpayer by income support.

If you then marry someone, or live together, it makes no difference, the earning partner is then expected to support the non-earning partner.

£23,000 pa is roughly £460pw this would exceed benefit entitlement for a couple and therefore your claim would cease.

Please note there is no difference to benefit paid to white and non-white benefit clients.

Bit bitter are we today Starlight? No need to be rude!

No! one’s partner is not *expected* to *keep* you. (your not an animal!) One can still claim some benefits.

Here’s what I was told it I went back to work and my partner was still at home. We rent so it could be a little different for your mortgage payments.

HB would be reduced but still payed out for the rent. They would cover around £400 HB for my partner and I the rest (Total is £700)

He would get £5 council tax benefit per week and I would cover the rest (total is £100)

He would still get Incapacity (reduced a little) (has been told he will not need to claim ESA as he’s an old claimant and been to a doctors exam) and full DLA.

    Income support would stop though.

So basically he would still get HB, council tax benefit, incapacity and DLA.
Now that’s still enough to cover the rent and his share of bills.
They work out the HB depending on my hours and pay but it was based on my prev monthly income of £1100. (I got them to work this out in case I can suddenly go back to work)

The best bet is to simply call and find out! The HB people were very helpful and worked through it all with me!

Forget yahoo answers because no one can really help as every person is different and your just going to get rude people and some may not have all the facts or info! You need the correct legal info here!
So give the DWP a call when you can and just make some *enquiries*
