No it doesnt , he is trying to rip you off, tell him he has had the first months rent twice and because you are entitled to housing benefit that money is yours, im not sure of where you live but i live in the UK,England and my landlord tried doing something similar to me, a lot of them do, if they can get away with it, go into your local housing office or ring up the local council and get put through to the housing benefit department, they will unlikely be able to directly help you but can certainly give you the name and details of someone that can, where i live it was a company called HIYAC, they tell you what you can do legally, and how to do it

you should contact the HB office and explain the situation to them, ask for any unpaid rent to be paid direct to you. if they have already paid to the end of the tenancy and he’s keeping your money he’s stealing and i would threaten him with legal action (the HB office may be able to advise you about this) – that will probably be enough to get him to give you what he owes you.
this is the kind of reason why i would never ever get my rent paid direct to the landlord when i was on benefits. i urge you to think twice before getting your HB paid direct to landlord in the future. Good Luck.
