Can my Mum claim housing benefit for a flat I have bought?

My mum currently receives housing benefit and lives in a privately rented flat. The flat is not ideal for her. I have been saving hard and now have enough money to buy a flat in the town she lives. I would then rent the flat to her. Can she continue to claim housing benefit to cover her rent?

I will not be living in the flat, I would charge only the going rate.

    You will have to be careful – if they find out (and they probably will) that the flat is yours they can be awkward

    it is not allowed.
    we have a tennant who is now living illegally in a house we own and her dad owns properties which he rents out and she cannot move to any of them as she will lose her housing benefit.

    your mother can live there rent free but that kind of defeats the point……

    Depends on the laws – but if you’re an adult and living on your own in another place then this is a valid landlord – renter relationship.

    Your mum would have to proove to the system that she is paying rent – documents are required to claim housing benefits and I believe you should be ok.

    But to be really sure you should speak with the department that is paying your mum benefits to see if this is legitimate.

    Yes she can get housing benefit. I live in a detached flat in my parents house, have a legal rental contract drawn up by a solicitor and claim housing benefit as I cannot work.
    The law does not discriminate as to who the owner of the flat is, they can be anyone.
    Get assessed for a fair rent by the council first.

    As Cyber says, as long as you do not live in the flat yourself, she can claim HB no problem. The council may ask to see the tenancy agreement, but as to who the flat belongs to does not matter. Just check the rental value around your area.

    Hi I work for housing benefits, yes it is possible for her to contnue to claim based on the fact that her current property is not suitable and you are purchasing one that is more suitable.

    One thing they will try to catch you out with when she claims will be, if she didn’t pay rent would you evict her, of course you wouldn’t but you might have to lie to them, also try to keep the rent slightly below the current rate if possible, this will go in your favour as it would mean to rent somewhere else would mean claiming more benefit.

    It is possible for her to claim but the council will question the claim, just make sure you tay one step ahead of the questions
