Can I get Housing benefit on a flat owned by my family?

I’m moving back to Scotland and was wondering if I can get benefit on a flat owned by my mother which she pays a mortgage on. What is the likelihood that Housing Benefit will cover the cost until I can start University in a month or two?

    I’ve never heard of anyone doing this, so I doubt you would be able to claim Housing Benefit. It may have been different if the flat was owned by an uncle or cousin, but as it’s your mother, they will probably say you should just live at home with her. Also if this was allowed I’m sure it would be open to all sorts of abuse.

    If you are paying rent to your mother (owner of the flat) then you should be able to get housing benefit or something to help with rent.

    Hold on there a mo! I just remember something. In order to get house-ben you have to already be getting some other ben – not sure what exactly. Least I think that’s how it works. Check with your local CAB – you can find them below – just put your post code into the slot.

    and, if social services – who whoever, will not play ball, here’s what you do. Find your local councillors, MSP, MP, MEP etc and get to work on them with a flood of e-mails etc.

    Go to this next site and chuck your PostCode into the slot and wham, you’ll get a link to your political reps etc.

    P.S. we’re living in the wrong country, I heard about one guy in France who has lived on French bens for the last 26 years and still gets a new car every few years – blimey!

    you have to be paying full rent and they have to rent it to you through an official agency to get contracts and things signed legal documents. also they will have to declare the rent as income to the tax office.

    If you qualify for benefit, they will pay, as long as the owner does not live in the property.
    Other than that, get a job for a few months, some students are so bl..dy lazy !!!!

    no u cannot rent from a relative and receiveHB. i was living with my mother she had to go into a care home, the house had to be sold to pay the fees i asked if i could rent it off her and get HB as it would have saved the council having to find me accommodation but they said no thats not allowed.

    You can claim housing benefit on a property owned by your mother providing their is a proper, signed and documented tenancy agreement and she would be prepared to evict you if you failed to pay rent or kept to the terms of your tenancy. The relationship MUST be declared correctly. At least that is the law in England. But what is actually paid will depend on the accommodation, how many people, what income comes into the house etc. And the tenancy must not be contrived in any way and a fair market rent must be adhered to. Best to approach the appropriate local authority for a pre-tenancy determination to see what rent may be paid.
