my partner is on incapacity benefit and i have recently been made redundant, we cant find any properties to rent as all say no dss and housing benefit, any ideas where to look?

Hi all,

I was given misinformation from my local authority. They told me I was entitled to up to £700 Housing Benefit per month for a 1 bedroom flat. However, I have since moved into a 1 bedroom flat and have now been told that I am NOT entitled to that amount – because they have an age restriction (you must be over 25 for a 1 bedroom flat allowance).

They did not tell me about the age restriction before-hand, and now I am in serious debt because of them and cannot afford my rent payments.

I thought there was maybe a Misinformation Act, but I can’t find any info anywhere.

What can I do about this? Do I have any rights at all? Surely there must be something for those who are given misinformation?

katt121 – I do have a job actually, I work from home as a Freelance Games Developer and I pay my taxes, and I have been working since I was 13, not that it is any of your business.

I do have proof of the amount they offered me, as they record all of their phone calls. They can review my phone call to them if it comes to that.
I don’t really need a lawyer lol, anyone who knows anything about law would be able to help me. It is a very simple question, I thought!

I thought that might have been the case, because they are the Local Authority they deem themselves as ‘untouchable’. So I guess I will have to think of a Plan B!

I know some people doing housing benefit fraud where I live. I had some problems with them recently and was thinking of reporting them to the council.

I felt that might be a bit merciless. Am just wondering whats the worst that will happen to them if they do benefit fraud? will they simply pay be made to pay the benefit back or could it be worser?

I wouldnt want them to go to prison or get evicted.

If you are in a couple and you both work but one of you gave up work to look after the baby, could you claim housing benefit. I realise it all depends on how much you earn etc but my question is, if you voluntary give up work do you have to wait a year before you can claim (as I think this is the case with jobseekers allowance) or can you claim straight away.
Before anyone starts crying – I work, I always have done, and so has my partner, we arent scroungers, I’m just asking!

I lost my job due to cut backs whilst 14 weeks pregnant, I managed to find another one but on a self employed basis so have discovered I will need to claim maternity allowance. This is only bout £120 a week obviously not enough to pay rent and all bills. Would I be entitled to housing benefit?

When I first signed my tenancy I paid deposit & months rent in advance. I claim housing benefit as I am a single parent, I have now given my notice in and my landlord is happy to give me my deposit back but not my months rent in advance.
The rent from housing benefit gets paid direct to him so does this mean he gets to have the months rent in advance paid twice?

My wife has been on maternity pay following the birth of our daughter. This has now run out so she has applied for Jobseekers Allowance but this has been denied because she’s not able to work full time. You know, what with the taking care of the baby thing.

We get child tax credits (not working tax credits because, shock, horror, I earn nearly £18,000 a year and that’s enough for a family of 3 to live on apparently) and, erm that’s it. We also don’t qualify for housing benefit or council tax benefits.

Is there anything else anyone knows of that we can try to claim? I know it’ll be hard because we’re married, white and I work for a living but there must be something we’ve missed and the staff at the local office are about one step up from useless!

I am currently working 16 hours a week at a rate of 5.99 per hour. I also claim Housing Benefit. HB currently pays some of my rent plus a reduction on Council Tax. The problem is in my current posistion there is just not enough money to support my outgoings. I have decided that I need to work more hours. How many hours could I add without any change to the amount of HB & CT Benefit I receive. How do they work it out?

My mum currently receives housing benefit and lives in a privately rented flat. The flat is not ideal for her. I have been saving hard and now have enough money to buy a flat in the town she lives. I would then rent the flat to her. Can she continue to claim housing benefit to cover her rent?

I will not be living in the flat, I would charge only the going rate.
